It is submitted by learned counsel for the petitioner that

though the petitioner has obtained higher marks from those

who have selected by the respondent-RPSC, however, alleging

that the petitioner is seeking to take double benefit of being an

ex-serviceman, he has not been selected, which action of the

respondent is contrary to the judgment in petitioner's own case

i.e. Ram Ratan & Ors. v. RPSC & Ors.: SBCW No. 3558/2020,

decided on 01.07.2020.

In view of the submissions made, issue notice. Issue notice

of the stay application also.

A copy of the petition be served on learned counsel Mr. Khet

Singh for respondent-RPSC and Mr. Hemant Choudhary, G.C. for

respondent-Secondary Education, they may complete their

instructions in the matter/file reply by the next date.

List the petition on 08.11.2021.

In the meanwhile and until further orders, the respondents

are directed to keep one post of Senior Teacher Grade-II (Social

Science) pursuant to the Advertisement dated 09.04.2018

(Annex.-4) in the category of Ex-serviceman (Non-TSP), vacant.
