The matter comes up on application preferred on behalf of

appellants under Section 5 of the Limitation Act.

However, as per the office report, the appeal is within

limitation.

The application under Section 5 of the Limitation Act stands

disposed of accordingly.

Learned counsel appearing for the appellants submits that

the controversy involved in the instant appeal is covered by order

dated 01.07.2021 passed by Hon'ble Supreme Court in Special

Leave to Appeal (C) No.7797/2021, whereby judgment passed by

(2 of 2) [SAW-498/2021]

a Bench of this Court in D.B.S.A.W. No.877/2019 has been

confirmed. Therefore, the present special appeal deserves to be

dismissed.

Accordingly, the present special appeal is dismissed in the

light of order dated 01.07.2021 passed by Supreme Court in

Special Leave to Appeal (C) No.7797/2021.
