Learned counsel for the petitioner submits that he has

already been deprived of the benefit of Assured Career

Progression for a period of three years on account of ineligibility

incurred on birth of third child but, now, he is being denied

promotion also on the same ground which is impermissible in view

of the judgment dated 29.11.2016 of this Court in SB Civil Writ

Petition No.10159/2015, Parbat Singh versus State of

Rajasthan & Ors.

Issue notice of the writ petition as well as of stay application.

Rule is made returnable by five weeks. Notices be filed in two

sets. One set of notices be sent through registered post with

acknowledgment due. Steps to be taken within a week.
