HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA

Order 20/11/2021

The present civil misc. appeal has been preferred against the

judgment and decree on the basis of a compromise arrived at

between the parties to which the appellant was a signatory.

In the appeal, he does not say that the compromise decree

has been passed fraudulently but submits that compromise decree

is in relation to a particular part of the property. Interpretation of

a compromise decree is the exclusive domain of the Executing

Court. Any objections in relation to the interpretation of a decree,

would not be a subject matter of civil misc. appeal.

Keeping in view thereto, this civil misc. appeal is found to be

without merit and it is accordingly dismissed.

All pending applications, if any, shall stand disposed of.
