Present petition has been filed with the prayer firstly for
removal of encroachment on the Government Gair Mumkin Abadi
Land on Khasra No.2833 of Village Bhagpura, Post Chhareda,
Tehsil Nangal Rajawatan, District Dausa and second to create
Public Land Protection Cell in rural areas of the old district of
Rajasthan for removal of the encroachment from the public land.
Taking judicial note of the fact that PLPC i.e. Public Land
Protection Cell has been created in almost all the districts of the
State and same are functioning, second prayer of the petitioner as
prayed for has already been taken care of by the State of
Rajasthan.
Sofar as first prayer of the petitioner is concerned, he may
approach the PLPC in view of the judgment passed by this Court in
Jagdish Prasad Meena and Ors. Vs. State of Rajasthan and
Ors. (decided on 30.01.2019) and file representation before
the PLPC. The same shall be considered and decided by the PLPC
within a period of six months from the date of filling of the
representation. The private respondents Nos.7 to 9 would also be
at liberty to present their case before PLPC and submit all the
evidence in support of the same. The authorities shall, after giving
opportunity of hearing both to the petitioner and the respondents,
decide the matter and if it reaches to the conclusion that
encroachments do exist, take appropriate action thereupon.
With these observations this petition is disposed of.
