D.B. Civil Misc. Application No.76/2021:-

The respondent appearing in person waives the Rule.

For the reasons stated in the application and those made out

during the course of the arguments, delay in filing the appeal is

condoned.

The application stands disposed of.

D.B. Special Appeal Writ No. 132/2021:-

Issue notice.

Respondent has already appeared in person. There is

therefore no need to serve notice to him.

List on 05.01.2022.

Learned AAG Mr. Rajesh Maharshi submitted that the State

Government had issued a notification dated 24.03.2011

rationalising certain pay scales of the State Government

employees which was done pursuant to the recommendation of

(2 of 2) [SAW-132/2021]

Krishna Bhatnagar Commission. As per this notification itself, the

revised pay scales would be applicable from the date of

notification. The respondent-original petitioner who had retired

with effect from 31.01.2010, was therefore not entitled to the

higher pay scale as per the notification dated 24.03.2011. It is

submitted that the learned Single Judge committed an error in

applying the amendments in the pay scales by virtue of the said

notification with retrospective effect from the inception of 2008

Pay Rules.

Issue requires further consideration.

The respondent appearing in person also requested that he

requires time to engage an Advocate to present his case.

By way of interim relief, impugned judgment of the learned

Single Judge is stayed.
