Counsel for the petitioner submitted that without deciding

the objections submitted by the petitioner with regard to

reassessment, the assessing authority has again passed the

reassessment order on 29.09.2021 (Annexure-15).

In support of his contentions, counsel for the petitioner relied

upon the judgment passed by the Division Bench of this court

passed in D.B. Income Tax Appeal No.292/2016 in the matter of

M/s K.C. Mercantile Versus Deputy Commissioner of Income Tax

Circle, Circle-2, Jaipur decided on 07.11.2017.

In that view of the matter, issue notice to the respondents

returnable on 09.12.2021.

Meanwhile, no coercive action shall be taken against the

petitioner.
