This writ petition has been preferred on behalf of the

petitioners being aggrieved with the award dated 07.06.2004

passed by the learned Labour Court, Bhilwara, whereby the

Labour Court, Bhilwara quashed and set aside the penalty order

dated 30.11.1995 imposed by the petitioners corporation upon the

respondent No.1- workman, who was working as driver with the

petitioners corporation.

It is notice that though this writ petition was admitted by this

Court on 08.07.2005, however, no stay was granted against the

award dated 07.06.2004. It is also noticed that as per the reply

preferred on behalf of the respondent No.1- workman, his age was

shown as 45 years in the year 2005, therefore, he must have now

attained the age of superannuation and taking into consideration

the above fact, I am not inclined to go into the merits of the case.

Hence, this writ petition is dismissed.
