Heard learned counsel for the petitioner as well as learned

public prosecutor.

The present petition has been filed against the order dated

26/10/2021 passed by learned Special Judicial Magistrate (N.I. Act

Cases) Court No.3, Bikaner, whereby the application preferred by

the petitioner to argue the matter before it has been rejected.

Learned counsel for the petitioner submits that in the

interest of justice, one opportunity may be granted to the

petitioner to argue the matter before learned trial Court.

On pointedly being asked by this Court, the reason for not

making submissions before learned trial Court since 26/03/2021,

no plausible explanation has been furnished by learned counsel for

the petitioner. As per the order dated 26/10/2021, the case was

already fixed for the judgment on 12/11/2021.

Since no plausible explanation has been furnished before this

Court nor before learned trial Court for not making the arguments,

the application has rightly been rejected by learned trial Court.

The same does not call for any interference.

Accordingly, the petition is, therefore, dismissed.
