1. With the consent of learned counsel for the parties, the

matters have been heard finally.

2. These writ petitions have been preferred claiming, in sum

and substance, the following reliefs:

"It is, therefore, prayed that this writ petition may kindly be allowed and the impugned orders dated 18.06.2019 (Annexure-23) and 03.05.2013 (Annexure-21) passed by the Board of Revenue, Ajmer and Revenue Appellate Authority, Jodhpur respectively may be quashed and set aside."

3. For the sake of convenience and brevity, the facts are being

taken from S.B. Civil Writ Petition No.16663/2019, while treating

the same as a lead case.

4. Brief facts of this case, as noticed by this Court, are that the

petitioner, vide registered sale deed dated 30.06.1989, acquired

his title pertaining to an agricultural land bearing khasra No.149/1

at Village Chopasani, Tehsil Jodhpur, District Jodhpur, which was

executed by the power of attorney holder of Smt. Bhikhi Devi,

namely, Ladu Ram.

5. It is relevant to note that Smt.Bhikhi Devi executed the

aforementioned power of attorney in favour of Ladu Ram on

17.03.1989 and the same was registered in the Office of Sub

Registrar, Jodhpur on 25.04.1989, and the aforementioned

registered sale deed, was the consequence of the said registered

power of attorney.

6. The petitioner thereafter, applied for conversion of the said

land in question for residential purposes, and the same allowed

vide conversion order dated 14.09.1989 passed by the Assistant

Collector, Jodhpur, and on 26.09.1989, the patta of the said plot

was accordingly issued accordingly in favour of the respective

purchasers.

7. The bone of contention in the present case is also an

agreement to sell between Durga Ram (now deceased), the

husband of Smt. Bhikhi Devi, and the concerned parties on

09.02.1981.

8. Mr. Ranveer Singh Mehta assisted by Ms. Pallavi Mehta and

Mr. Ankit Bhaskar, learned counsel for the petitioners submits that

the agreement to sell entered into between Late Durga Ram and

the petitioner (in CWP No.16663/2019) on 09.02.1981 and other

similarly situated persons for their respective portions arising out

of 16 bighas of the land (land in question) was perfectly legal.

9. Learned counsel for the petitioners further submits that the

16 bigha land was in the share of Late Durga Ram, as per the

order passed by the Tehsildar, Jodhpur on 27.07.1982, which was

a mutual partition, and though it was passed subsequently, but it

was known to the parties that they shall be acquiring such share,

and thus, the aforementioned agreement to sell was valid.

10. Learned counsel for the petitioners also submits that Durga

Ram passed away on 19.10.1988 and the agreement to sell

executed by him in the year 1981 culminated into a passing on of

a valid title; furthermore, the sole heir of Late Durga Ram was his

wife, namely, Smt. Bhikhi Devi, who executed a power of attorney

in favour of Ladu Ram on 17.03.1989 (registered on 25.04.1989);

the same enabled the parties to get the registered deed done.

11. Learned counsel for the petitioners further submits that the

registered documents are presumed to be correct, and therefore,

there is not an iota of doubt regarding passing on of the title, in

respect of the land in question, from Smt. Bhikhi Devi to the

present petitioners.

12. Learned counsel for the petitioners also submits that Smt.

Bhikhi Devi, being the sole owner of 16 bigha of land in question

bearing khasra No.149/1, has validly passed on the title thereof to

the present petitioners, and thus, the conversion of the land in

question at the instance of the title holders was absolutely lawful.

13. Learned counsel for the petitioners has drawn attention of

this Court towards Annexure-R/5 of reply to writ petition

No.16663/2019, which was an inspection report of the concerned

authority, which reflects that while the conversion was being

contemplated, the aforementioned registered sale deed was

before the authorities.

14. Learned counsel for the petitioners has also drawn the

attention of this Court towards the agreement to sell, in which

part payment was made and thereafter, the learned counsel also

drew the attention of this Court towards the registered sale deed,

wherein it was accepted that the complete amount of sale

consideration has been received by the respective parties, though

the earlier agreement has been mentioned in the registered sale

deed.

15. Learned counsel for the petitioners also submits that the

registered sale deed contains all the necessary details of the valid

sale, and thus, the passing of the title was perfectly lawful and the

consequential conversion and issuance of patta were also in

accordance with law.

16. Learned counsel for the petitioner further submits that the

application for conversion of the land for residential purposes was

moved by the petitioners under the Rajasthan Land Revenue

(Allotment, Conversion & Regularization of Agricultural Land for

Residential, Commercial and Public Utility Purposes in Urban

Areas) Rules, 1981 before the Assistant Collector, Agricultural

Land Conversion, Jodhpur, and after the same being processed,

the conversion order was passed accordingly.

17. Learned counsel for the petitioners also submits that the suit

filed by Smt. Bhikhi Devi was a tenancy suit bearing No.139/1989

under Sections 88, 89, 53 and 183 of the Rajasthan Tenancy Act,

1955, and thus, the same had no bearing upon the present

petitioners, as it was her independent right being exercised

against the other co-sharers.

18. Learned counsel for the petitioners further submits that the

adoption of Kan Singh @ Kana Ram by Late Durga Ram/Smt.

Bhikhi Devi was also doubtful, as neither the same, nor the valid

adoption deed was not brought on record earlier.

19. Learned counsel for the petitioners thereafter submits that

after a delay of 17 years from the issuance of patta in favour of

the petitioners, some persons filed an appeal before learned

Revenue Appellate Authority, Jodhpur against the aforementioned

order of conversion/issuance of patta.

20. Learned counsel for the petitioners also submits that in the

meanwhile, it also happened that Kan Singh @ Kana Ram

transferred the land in question in favour of some other persons

by a registered sale deed.

21. Learned counsel for the petitioners further submits that the

land transferred by Kan Singh @ Kana Ram in favour of others

was taken by them by paying the stamp duty for residential

purposes, which is now being challenged by them.

22. Learned counsel for the petitioners however submits that

learned Revenue Appellate Authority, Jodhpur arbitrarily, vide the

impugned order dated 03.05.2013 allowed the appeal and set

aside the conversion orders issued in the year 1989 as well as the

pattaa issued in favour of the petitioners, while much relying upon

the agreement to sell executed between Late Durga Ram and the

parties on 09.02.1981.

23. Learned counsel for the petitioners also submits that the

petitioners thereafter, preferred a second appeal before the

learned Board of Revenue for Rajasthan at Ajmer, but the same

was dismissed vide the impugned order dated 18.06.2019, while

upholding the order of learned Revenue Appellate Authority,

cancelling the conversion and the patta in question.

24. On the other hand, Mr. J.L. Purohit, learned Senior Counsel

assisted by Mr. Rajeev Purohit appearing on behalf of the

respondents vehemently opposes the petitions on the ground that

both the impugned orders were justified, as the agreement to sell

dated 09.02.1981, which was basis of the sale deed executed and

registered later on, itself was doubtful. Learned Senior Counsel

thus submit that the chain of documents in favour of the

petitioners was not perfectly justified, and therefore, it was a fit

case for cancellation of the conversion orders and the patta in

question.

25. Learned Senior Counsel for the respondents also submits

that the power of attorney executed by Smt. Bhikhi Devi in favour

of Ladu Ram on 17.03.1989, which was registered on 25.04.1989

as well as the registered sale deed dated 30.06.1989, cannot be

believed, and thus, the consequential proceedings have to be

nullified.

26. Learned Senior Counsel for the respondents further submits

that the purported sale agreement dated 09.02.1981 said to be

executed by Late Durga Ram was not a genuine document but a

fabricated document. Learned Senior Counsel also submits that on

09.02.1981, Late Durga Ram was still in joint khatedari in khasra

No.149 and was having no independent right in respect of 16

bighas land, and no khasra No.149/1 existed until mutation dated

03.08.1982. As per learned Senior Counsel, the sale agreement

dated 09.02.1981 was, therefore, void ab initio and non est in the

eye of law.

27. Learned Senior Counsel for the respondents also submits

that the sanctity and genuineness of the sale agreement dated

09.02.1981 and the General Power of Attorney dated 17.03.1989

are also doubtful. Learned Senior Counsel further submit that the

document dated 09.02.1981 was stated to be executed by Late

Durga Ram, but this document does not contain his thumb

impression, whereas Late Durga Ram was a literate person and he

did signature; Late Durga Ram died on 19.10.1988 i.e. he was

alive on 09.02.1981.

28. Learned Senior Counsel for the respondents further submits

that the thumb impressions of Smt. Bhikhi Devi on documents

dated 09.02.1981 and 17.03.1989 (registered on 25.04.1989) are

evidently different.

29. Learned Senior Counsel for the respondents also submits

that the purported sale deed dated 30.06.1989 is shown to be

executed by Smt. Bhikhi Devi through power of attorney holder

Ladu Ram; stated to be executed in pursuance of the

aforementioned sale agreement dated 09.02.1981 by endorsing

that the whole amount of sale consideration was obtained by Shri

Durga Ram while entering into sale agreement on 09.02.1980,

whereas in the sale agreement dated 09.02.1981, it was

specifically mentioned that out of the total agreed sale

consideration of Rs.80,000/-, an amount of Rs.5,000/- has been

received, and whenever remaining amount of Rs.75,000/- will be

paid (upto year 1990), first party shall execute the sale deed for

registration in favour of second party.

30. Learned Senior Counsel for the respondents further submits

that Smt. Bhikhi Devi has been contesting the suit against co-

khatedars and appeal regarding subject land from the year 1989

till her demise in the year 2001, but nowhere, at any point of

time, she expressed that she has ever executed any sale deed or

power of attorney.

31. Learned Senior Counsel for the respondents also submits

that Smt. Bhikhi Devi also executed an adoption deed on

25.10.1994, adopting Kana Ram s/o Bhala Ram as per desire of

her husband Late Durga Ram; the adoption deed was registered

before the Sub Registrar-II, Jodhpur on 25.10.1994.

32. Heard learned counsel for the parties at length and carefully

perused the record of the case.

33. In the pleadings of the respondents, they have also mixed up

the issue of the suit filed by Smt. Bhikhi Devi and tried to use it in

favour of Kan Singh.

34. This Court finds that though certain lacuna have been

pointed out in the initial agreement to sell dated 09.02.1981, but

thereafter, the prospective events of a power of attorney being

executed on 17.03.1989 by Smt. Bhikhi Devi, who was the sole

owner of the land in question, and registration of such power of

attorney in the Office of Sub Registrar, Jodhpur on 25.04.1989,

clinches the issue in favour of the conversion proceedings initiated

at the instance of the present petitioners, and the patta held by

them consequently.

35. It is noted that Late Durga Ram was the original owner of

the 16 bighas of land undisputed, after 27.07.1982, but he had

expired on 19.10.1988, and thus, Smt. Bhikhi Devi was the sole

owner of the land in question. Even the entry of the adopted son

is shown by registered adoption deed dated 25.10.1994, which

was much subsequent to the power of attorney and the sale deeds

in question.

36. The inspection report of the concerned authority, which is on

record as Annexure R/5 clearly points out that the registered

power of attorney and registered sale deeds were within the

knowledge of the concerned authority, while passing the

conversion orders.

37. This Court cannot accept that after an inordinate delay of 17

years from the date of passing of the conversion orders in the

year 1989, the same has been challenged by the respondents,

even when Smt. Bhikhi Devi did not do the same in her lifetime

and nor her legal heirs did so.

38. Smt. Bhikhi Devi herself was alive for 12 years thereafter

and has not challenged the registered power of attorney and the

registered sale deeds, which have resulted into passing of the

conversion orders and issuance of the patta in question.

39. This Court also takes note of the fact that Rule 5 of the

Rajasthan Land Revenue (Allotment, Conversion & Regularization

of Agricultural Land for Residential, Commercial and Public Utility

Purposes in Urban Areas) Rules, 1981 prohibits conversion of

certain lands, but the conversion made at the instance of the

present petitioners does not fall within such prohibition. The

possession of the petitioners is already there as per their record.

40. It is also noted by this Court that the land in question has

been entered in the master plan as a residential area, and thus, it

was well within the knowledge of all that it has been converted,

and thus, any challenge thereto after an inordinate delay of 17

years cannot be permissible.

41. The present judgment of this Court also takes strength from

the precedent law laid down by the Hon'ble Supreme Court in

Rattan Singh & Ors. Vs. Nirmal Gill & Ors. etc. (Civil Appeal

Nos.3681-3682 of 2020, decided on 16.11.2020, by which

the emphasis upon the presumption of genuineness of the

registered documents, which had been validly executed, has been

applied.

42. This Court finds that in this case also, the record reveals that

the disputed documents, namely, registered power of attorney and

the registered sale deeds are to be understood in the perspective

of the presumption in favour of the registered documents, as it is

a settled legal position that a document is presumed to be genuine

if the same is registered, as held by the Hon'ble Supreme Court in

Prem Singh & Ors. Vs. Birbal & Ors., reported in (2006) 5

SCC 353. The relevant portion of the judgment in Prem Singh &

Ors. (supra) reads as under:

"27. There is a presumption that a registered document is validly executed. A registered document, therefore, prima facie would be valid in law. The onus of proof, thus, would be on a person who leads evidence to rebut the presumption. In the instant case, Respondent No.1 has not been able to rebut the said presumption."

43. This Court also finds that the title of Late Durga Ram over 16

bigha of land in question is undisputed, since 27.07.1982. The title

of Late Durga Ram undisputedly passed on to his wife Smt. Bhikhi

Devi on 19.10.1988, as she was the sole survivor after the death

Durga Ram. Smt. Bhikh Devi, in her full sense, has executed the

power of attorney on 17.03.1989, which was registered in the

Office of Sub Registrar, Jodhpur on 25.04.1989. The said

registered power of attorney has resulted into registered sale

deed, and the said sale deed alongwith the initial agreement of

1981, has culminated into conversion of the land in question from

agricultural to residential purposes in the same year of 1989.

44. Had this case sustained only on the basis of the initial

agreement of 1981 between Late Durga Ram and the parties ,

then more proof was to be gathered before arriving at a

conclusion, but now a safe conclusion can be drawn regarding title

of the present petitioners in pursuance of the registered power of

attorney and the registered sale deeds between the competent

parties, which are not even under challenge.

45. This Court thus holds that if the title is proved beyond

reasonable doubt in last two documents of power of attorney and

consequential registered sale deed, then even if the original

agreement to sell is defective, the sale shall be held to be valid in

lieu of the subsequent independent sustenance of the power of

attorney and registered sale deed.

46. The challenge after an inordinate delay of 17 years to the

conversion orders, even when the persons stepping into the shoes

of Kan Singh themselves have paid the stamp duty for the purpose

of the land in question to be used for residential purposes, cannot

be accepted, by any stretch of imagination.

47. Both the learned courts below have proceeded to cast doubt

upon the documents at initial stage, but have not considered that

the registered power of attorney and subsequent sale deed have

cemented the claim and title of the present petitioners, who have

undergone the conversion of the land in question for residential

purposes. The master plan and the other documents also clearly

show the lawful conversion having been done.

48. Both the impugned orders have gone into some

technicalities, namely, absence of signature of the authority who

calculated the stamp duty, absence of complete address of the

plaintiff, absence of notice and opportunity of hearing, raising of

objection at a belated stage and lack of jurisdiction of the revenue

court in respect of determination as to legality of the agreement to

sell and the sale deed; but once the registered documents are

relied upon, no doubt remains that the conversion order on the

basis of the title of the present petitioners was perfectly lawful,

and cannot be challenged at a belated stage i.e. after an

inordinate delay of 17 years.

49. Moreover, the respondents themselves are estopped from

taking any other course since their so called registered sale deed

also is based upon the land having been converted for residential

purposes, as though they initially got the land registered as

agricultural land, but subsequently, paid the difference of stamp

duty for treating the land to be used for residential purposes.

50. In light of the aforesaid discussion, the present petitions are

allowed and the impugned orders dated 03.05.2013 and

18.06.2019 are quashed and set aside. All pending applications

stand disposed of accordingly.
