Mr. D.K. Godara is appearing on behalf of the sole

respondent. Service is, therefore, complete.

Having heard learned counsel for the parties and after going

through the averments made in the application under Section 5 of

the Limitation Act, the same is allowed and the delay of 97 days in

filing the appeal is condoned.

Issue notice of appeal.

Mr. D.K. Godara accepts notice on behalf of the sole

respondent.

Mr. Sandeep Shah, AAG has submitted that the learned

Single Judge has allowed the writ petition filed by the petitioner

while relying on the decision of the Single Bench of this Court in

(2 of 2) [SAW-1414/2019]

S.B. Civil Writ Petition No.19166/2018 - Kuldeep Bhakar Vs. State

of Rajasthan and Ors. It is further submitted that Kuldeep

Bhakar's case was decided on the basis of the judgment rendered

by the learned Single Judge in Love Kush Meena's case, however,

the said judgment was reversed by the Hon'ble Supreme Court

vide judgment dated 24.03.2021 passed in Civil Appeal

No.3894/2020.

Mr. D.K. Godara, learned counsel appearing for the

respondent has disputed the said position and prays for some time

to argue the matter. Time prayed for is granted.

List the matter on 07.12.2021.

In the meantime, effect and operation of the impugned order

dated 22.04.2019 passed by learned Single Judge in SBCWP

No.513/2019 shall remain stayed.
