Judgment

The instant writ petition has been filed by the convict-

petitioner for assailing the adverse recommendations dated

09.02.2021 whereby the application for first parole filed on behalf

of the petitioner has been rejected.

We have heard and considered the submissions advanced at

bar and have gone through the material available on record.

The petitioner has been denied parole because his conduct in

jail was found to be unsatisfactory. On 04.08.2019, during

surprise search, the petitioner was found in possession of a mobile

phone for which, a criminal case was registered against him and

jail punishment was imposed against him.

In view of this fact, apparently, the conduct of the petitioner

inside the jail is totally unsatisfactory. Thus, we are not inclined to

enlarge the petitioner on parole while exercising extraordinary

jurisdiction of this Court. The petitioner is given liberty to renew

the prayer of parole after one year from the date of decision of the

criminal case registered against him for having in possession of

the mobile phone.

With above observations, the parole writ petition is rejected.
