1. Petitioner has filed this second bail application under Section

439 Cr.P.C.

2. F.I.R. No.74/2020 was registered at Police Station Didwana,

Nagaur, Rajasthan for offence under Sections 498-A & 304-B I.P.C.

3. It is contended by counsel for the petitioner that the

information about death of deceased was given to her family

members. It is also contended that the statement of Doctors have

been recorded. Although in the postmortem report, there is

allegation of throttling but in the cross-examination, it is revealed

that the deceased was not murdered by the present petitioner.

4. Learned Public Prosecutor and counsel for the complainant

(2 of 2) [CRLMB-2857/2021]

have opposed the second bail application. It is contended that

there was sign of throttling on the neck of the deceased and she

was cremated without informing her family members. Later on

when the report was filed, her body was dug out and was sent for

postmortem.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

State, I am not inclined to entertain the second bail application.

7. This second bail application is, accordingly, dismissed.
