Learned counsel for the petitioner has submitted that

the petitioner has falsely been implicated in this case. It

is argued that the police have failed to collect documents

and concrete evidence against the petitioner. It is further

submitted that now statements of some of the

prosecution witnesses have been recorded before the trial

court and from perusal of the same, it is clear that the

prosecution has failed to prove beyond reasonable doubt

that the petitioner was involved in the commission of

crime.

Learned Public Prosecutor as well as learned counsel

for the complainant have vehemently opposed the bail

application and argued that from the statements of the

complainant and other prosecution witnesses, it is clear

that it was the petitioner who committed the crime, for

which, charge-sheet has been filed against him. It is also

submitted that statements of around ten prosecution

witnesses have been recorded before the trial court and

in such circumstances, the petitioner is not entitled to be

enlarged on bail.

Having heard learned counsel for the parties and

after going through the material available on record, I am

not inclined to grant bail to the petitioner.

Hence, this third bail application is dismissed.
