Heard. Perused the material available on record.

Considering the overall facts and circumstances as

available on record, I am of the opinion that it is a fit case for

granting leave to the applicant appellant for filing appeal against

the impugned Judgment of acquittal dated 19.01.2018 passed by

learned Special Judge, NDPS Act Cases, Sujangarh, District Churu

in Sessions Case No.14/2016.

Thus, the leave to appeal application is accepted and

the same shall be registered as an appeal.

Admit.

Issue notice.

Mr. Sunil Bishnoi, Advocate, appears on behalf of the

respondent. He shall ensure that his client appears before the

Deputy Registrar (Judicial), Rajasthan High Court, Jodhpur within

next 30 days and furnishes a personal bond in the sum of

(2 of 2) [CRLLA-330/2018]

Rs.1,00,000/- and a surety in the like amount to his satisfaction

so as to ensure presence of the accused in this Court as and when

required.
