Judgment
08/07/2021
(1) By way of the present writ petition, the petitioner has
challenged order dated 28.1.2021 whereby petitioner's
representation for according appropriate place of posting where
his wife is working, has been turned down.
(2) Mr. Bansal, learned counsel appearing for the petitioner
argues that pursuant to the order dated 18.1.2021, the petitioner
moved a representation dated 28.1.2021 and pointed out four
schools where the posts of Lecturer (subject Hindi) were lying
vacant. Apart from above, the petitioner also requested to
(2 of 2) [CW-6149/2021]
transfer him to a nearby school where his wife is working,
however, the respondents had passed a cyclostyle order without
dealing with the representation filed by the petitioner.
(3) A reply to the writ petition has been filed inter alia, stating
that the posts of the School Lecturer (Hindi) in the schools where
the petitioner has sought his transfer are not vacant, while
maintaining that the petitioner is in State Level Service and thus,
he can be transferred anywhere in the State.
(4) Having regard to the facts of the present case, particularly
because the petitioner is a Lecturer and has been posted in the
same District, where his wife is posted, this Court does not find
any reason to interfere.
(5) The writ petition, therefore, fails.
(6) The stay application also stands disposed of accordingly.
