This bail application has been filed under Section 439 Cr.P.C.

in connection with FIR No.337/2020 registered at Police Station,

Sanchore, District Jalore for offence under Section 19/54 of the

Rajasthan Excise Act and sec.411 IPC.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the entire material available on

record.

Learned counsel for the petitioner submits that the petitioner

is not involved in the said incident and he has been arrested on

the basis of previous cases.

Learned Public Prosecutor has opposed the bail application

and submitted that there are seven cases against the petitioner of

similar offence.

Having considered the submissions and taking into

consideration the overall facts and circumstances of the case,

without commenting on merits of the case, I deem it just and

proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and it is ordered

that the accused petitioner - Raghunath Ram s/o Pukhraj be

released on bail under Section 439 Cr.P.C. in connection with

aforesaid FIR No.337/2020 registered at Police Station Sanchore,

District Jalore provided the petitioner furnishes a personal bond of

Rs.20,000/- with one surety in the like amount, to the satisfaction

of the concerned Magistrate with the stipulation that he shall

comply with all the conditions laid down under Section 437(3)
