The matter comes up on an application under Article 226(3)

of the Constitution of India seeking vacation of the order passed

by this Court dated 6.03.2020.

Learned counsel for the petitioner relies on judgment passed

by Supreme Court in Jaswant Singh Versus State of Punjab &

Ors. reported in 1991 (1) SCC 362 to submit that the facts of the

present case are almost identical.

The facts mentioned in the order dated 6.03.2020 are

however not disputed by the counsel for the State that on

25.02.2020 alone show cause notice was given to the petitioner

and on that very day by the same officer, the petitioner has been

dismissed without waiting for reply of the show cause notice.

There is no mention in the order of dismissal about show cause

notice having been served.

This Court also notices that both the orders have been

passed by the same officer and the numbering on the orders i.e

523 in show cause notice and 524 in the dismissal order are also

consequential. Thus, this Court does not find any reason to

interfere with the order passed by the Court dated 6.03.2020 and

the application for vacation is dismissed.
