1. Learned counsel for the petitioner undertakes to remove the

defects within a period of one week.

2. Mr. Bhaleria, learned counsel for the petitioner submits that

the impugned order dated 31.12.2020, sending the petitioner

from Panchayat Samiti Sangaria to any other Panchayat Samiti,

out of the Assembly area, is contrary to the judgment dated

20.01.2020 of this Court rendered in the case of Chandrakanta Vs.

State of Rajasthan & Ors.

3. The matter requires consideration.

4. Issue notice. Issue notice of stay application also, returnable

within six weeks.

                                   5.   Meanwhile,   effect     and      operation        of      the   order   dated

31.12.2020 qua the petitioner, shall remain stayed.

6. List this case along with SBCWP No.174/2021.
