Judgment

27/01/2021

1. The petitioner has approached this Court with the grievance

that Departmental enquiry, which was initiated against him

pursuant to charge-sheet dated 27.06.2014 is still pending, due to

which his future prospectus are being adversely affected.

2. Mr. K.P.S. Bhati, learned counsel for the petitioner invited

Court's attention towards the representation dated 18.10.2018

(Annex.9), which the petitioner has made to the competent

authority with a request to expedite his departmental proceedings

(2 of 2) [CW-282/2021]

and submitted that despite his persuasion, nothing has been done

by the respondents, to conclude the enquiry at an early date.

3. The present writ petition is, therefore, disposed of with the

direction to the competent authority to conclude the departmental

enquiry, pending against the petitioner within a period of six

months of placing certified copy of the order instant alongwith the

photostat copy of the representation aforesaid.

4. It is made clear that aforesaid direction to decide the

representation has been issued only with a view to ensure

expeditious redressal of petitioner's grievance. The same may not

be construed to be an order to decide the representation in a

particular manner.

5. The stay application also stands disposed of accordingly.
