1. Petitioner has filed this bail application under Section

439 of Cr.P.C.

2. F.I.R. No. 216/2020 was registered at Police Station Tehla,

District Alwar for offence under Sections 332, 353, 307, 323, 379,

302 of I.P.C.

3. It is contended by counsel for the petitioner that petitioner

never intended to commit the offence of murder.

4. Learned Public Prosecutor has opposed the bail application.

It is contended that petitioner was committing the offence of

illegal mining in the forest area and when the forest guard came

and tried to stop him, petitioner hit the forest guard with his

tractor, as a result of which the guard expired.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

State, I am not inclined to entertain the bail application.

7. This bail application is accordingly dismissed.
