1. Mr. Mukesh Rajpurohit, learned ASG appearing for the AIIMS,

New Delhi raised an objection that as per the notification dated

22.06.2017, issued by the Central Government, the jurisdiction to

deal with the matters, relating to the recruitment and other

incidental matters in relation to the employees of All India

Institute of Medical Sciences has been conferred on Central

Administrative Tribunal.

2. Learned counsel appearing for the petitioner fairly conceded

that the jurisdiction to deal with the matters relating to the

recruitment and other identical matters in relation to the

employees of AIIMS is with the Central Administrative Tribunal,

therefore, he seeks permission to withdraw the present writ

petition, however, with a liberty to approach the Central

Administrative Tribunal for redressal of his grievance.

3. In such circumstances, the writ petition is dismissed as

withdrawn with the liberty to the petitioner to approach the

Central Administrative Tribunal within a period of one month from

today.

4. Needless to observe that the period during which instant writ

petition remained pending before this Court (from 20.03.2018 to

23.02.2021) shall be excluded while calculating the limitation.
