Heard learned counsel for the parties and perused

the material available on record.

Learned counsel for the petitioner has submitted that

the petitioner has falsely been implicated in this case. It

is argued that no evidence is available on record to

connect the petitioner with the commission of crime. It is

also submitted that as per the post-mortem report, the

cause of death of the deceased has yet not been

ascertained. It is, thus, prayed that the petitioner may be

enlarged on bail.

Per contra, learned Public Prosecutor has opposed

the bail application and submitted that from the charge-

sheet, it is clear that the stolen articles were recovered at

the instance of the petitioner and sufficient material is

available on record to connect the petitioner with the

commission of crime.

Having regard to the overall facts and circumstances

of the case, I am not inclined to grant bail to the

petitioner.

Hence, this bail application is dismissed.
