1. The present appeal is reported to be barred by 28 days.

2. For the reasons stated, the application seeking condonation

of delay is allowed. The delay in filing the appeal is condoned.

3. Mr. Shridhar Mehta, learned counsel for the respondent, at

the outset, submitted that the controversy involved in the present

writ petition has been set at rest by the Division Bench of this

Court vide its judgment dated 30.09.2019, passed in D.B. Special

Appeal (Writ) No.877/2019; State of Rajasthan & Anr. Vs. Vimla

Devi Saini.

4. Mr. Pankaj Sharma, learned Additional Advocate General is

not in a position to dispute the aforesaid position of facts and law.

5. In view of the aforesaid and following the judgment rendered

by the Division Bench of this Court in State of Rajasthan & Anr.

Vs. Vimla Devi Saini (supra), the present appeal is also dismissed.

6. Stay petition also stands dismissed accordingly.
