1. Mr. Shridhar Mehta, learned counsel for the respondent, at

the outset, submitted that the controversy involved in the present

writ petition has been decided by the Division Bench of this Court

vide its judgment dated 30.09.2019, passed in D.B. Special Appeal

(Writ) No.877/2019; State of Rajasthan & Anr. Vs. Vimla Devi

Saini.

2. Mr. Pankaj Sharma, learned Additional Advocate General is

not in a position to dispute the aforesaid position of facts and law.

3. In view of the aforesaid and following the judgment rendered

by the Division Bench of this Court in State of Rajasthan & Anr.

Vs. Vimla Devi Saini (supra), the present appeal is also dismissed.

4. Stay petition also stands dismissed accordingly.
