Heard learned counsel for the parties and perused
the material available on record.
Learned counsel for the petitioner has submitted that
the petitioner has falsely been implicated in this case. It
is argued that the petitioner had no motive for
commission of crime, which the other co-accused persons
may had. It is further submitted that there is a delay of
around 12 hours in filing the FIR. It is also submitted that
no specific role has been assigned to the petitioner. It is
submitted that co-accused Vinod has already been
enlarged on bail. Learned counsel for the petitioner, thus,
prayed that the petitioner may be enlarged on bail.

Per contra, learned Public Prosecutor has opposed
the bail application and submitted that the petitioner is
named in the FIR and the prosecution witnesses, who
have been examined so far, have also named him.
Having regard to the overall facts and circumstances
of the case, I am not inclined to enlarge the petitioner on
bail.
Hence, this second bail application is dismissed.
