Heard on application (IA No. 1165/2020) filed under
Section 5 of the Limitation Act for condonation of delay in filing
the appeal.
Learned counsel submits that against the impugned
judgment and order dated 03.03.2020 passed by the Additional
District Judge No.11, Jaipur Metropolitan, Jaipur, Civil First Appeal
No. 554/2020 has been filed by the respondent-defendant.
Counsel further submits that on account of COVID-19 pandemic,
applicant could not contact with the counsel.

Taking note of the overall facts and circumstances of
the case, the application filed under Section 5 of the Limitation Act
is allowed and delay in filing the appeal is condoned.
Admit.
Service is complete.
Service of notice upon respondents No. 2 and 3 is
dispensed with.
In the meantime, both the parties shall not create any
third party right or interest till disposal of the appeal.
