This Court finds that the petitioner had applied for the

compassionate appointment and he was informed vide letter dated

28.08.2007 that he was eligible for appointment as Class IV

employee. As and when the seat is vacant, and he shall be offered

appointment. However on 13.09.2011 after four years, the

petitioner's application was rejected mentioning the judgments of

Supreme Court and also mentioning that the petitioner has a

share in the inherited house and agricultural land and the FCI has

released the sum of Rs.4.29 lacs as PF.

Let the Assistant General Manager, FCI shall place before the

Court the list of appointments given on compassionate grounds in

between 28.08.2007 to 13.09.2011.

List this case again on 24.02.2021.
