The appellant-plaintiff filed recovery suit for Rs.54,958/- on

account of withholding 5% amount by the defendant against the

contract. The suit for recovery of this amount was dismissed by the Trial

Court vide judgment and decree dated 02.09.1997.

Learned counsel for the appellant seeks time to take instructions

from his client as to whether the appellant-plaintiff wants to pursue this

first Appeal on merits or not.

This Court, vide order dated 17.11.1998 called for the record of

Trial Court, however, record has not yet been summoned.

Let requisition to summon the record of the Trial Court be issued

again.

Put up after four weeks.

Learned counsel for the appellant is expected to be ready with the

update instructions or in the alternative, to argue the appeal on merits.
