Present writ petition has been filed aggrieved by the charge-

sheet dated 19.07.2018 served on the petitioner vide which

disciplinary proceedings against the petitioner had been initiated

under the provisions of Rule 16 of the Rajasthan Civil Services

(Classification, Control & Appeal) Rules, 1958.

Counsel for the petitioner has relied upon the judgment

passed by Hon'ble Apex Court in the case of Prem Nath Bali Vs.

Registrar, High Court of Delhi & Ors. (Civil Appeal No.

958/2010) and Order passed by Co-ordinate Bench of this Court in

S.B. Civil Writ Petition No. 18314/2018; Dr. N K Tomar Vs. The

State of Rajasthan & Ors.

In light of the above judgments, present writ petition is

disposed of with a direction to the respondents to take

(2 of 2) [CW-21953/2019]

final decision on the departmental proceedings positively within a

period of four months from the date of submission of certified

copy of this order.

It is made clear that the petitioner shall co-operate with the

DOP to get a final decision with regard to the aforesaid charge-

sheet.

With the aforesaid observations, the present writ petition

stands disposed of.
