This matter has come up on an application (IA
No.301/2021) for condoning the delay in filing the revision
petition.
It has been submitted that in this case, the petitioner
was on bail during the trial as well as during appeal and the
learned Appellate Court passed the impugned judgment dated
06.09.2018 in the absence of the petitioner. Hence, the petitioner
was not having knowledge of the impugned judgment. Delay
caused in filing the revision petition was bonafide and not
intentional.
Hence, looking to the facts and circumstances of the
case and in the interest of justice, delay caused in filing the
revision petition may be condoned.
Heard.
In view of the submissions and facts that the petitioner
is behind the bar, the application is allowed. Delay in filing the
revision petition is condoned.
