1. It is contended by counsel for the petitioner that similarly

situated co-accused-Rakesh Gurjar has been enlarged on bail by

this Court.

2. I have perused the record.

3. At the time when bail application of co-accused-Rakesh

Gurjar was being argued, it was informed by the counsel that

similarly situated co-accused has been enlarged on bail. I have

perused the order of Vikram Gurjar dated 26.02.2021, wherein it

was mentioned that the only allegation against Vikram was that

the place of occurrence was identified by him. From the statement

of victim, it is evident that Rakesh Gurjar and the present

petitioner both were identified by the victim in test identification

parade as well as in the Court.

4. Register a Suo Moto bail cancellation application with regard

to accused-Rakesh Gurjar.

5. Issue notice to Rakesh Gurjar.

6. List the present second bail application alongwith the suo

moto bail cancellation application after service of the accused-

respondent.
