1. Mr. Godara, learned counsel for the petitioner, submits that

identical writ petition has been allowed by this Court vide order

dated 25.02.2020 in the case of Dr. Yudhveer Singh Vs. State of

Rajasthan & Ors. (SB Civil Writ Petition No.17205/2018).

2. Ms. Bhansali, learned counsel for the respondents, submits

that the order dated 25.02.2020 relied upon by the learned

counsel for the petitioner was passed in light of judgment

rendered in the case of Dr. Prem Singh Vs. Sate of Rajasthan &

Ors. (SB Civil Writ Petition No.9583/2008) and in an appeal there

against so also against the order dated 25.02.2020, the Division

Bench has stayed the effect and operation of the order.

3. Mr. Godara, learned counsel for the petitioner, submits that

keeping this matter pending before Single Bench would serve no

purpose and in case this petition is allowed, the present petitioner

will also have an opportunity to contest the matter before the

Division Bench.

4. In view of the aforesaid, the writ petition is allowed in terms

of judgment dated 12.02.2014 rendered in the case of Dr. Prem

Singh (supra). The respondent - State is directed to grant benefit

of continuity of service to the petitioner. Further, it is ordered that

the period of his service rendered earlier shall be reckoned from

his initial date of appointment for all purposes.

5. All interlocutory applications stand disposed of.
