The instant misc. petition has been filed by the accused-
petitioner Koja Ram with a prayer to quash the proceedings of the
FIR No.04/2020 registered at Police Station Bhawanda, District
Nagaur to his extent.
On going through the contents of the impugned FIR and the
factual report submitted by learned Public Prosecutor, it is
apparent that the petitioner Koja Ram is specifically named in the
FIR as being one of the members of the unlawful assembly which
brutally assaulted the complainant party causing grievous life
threatening injury to Bheru Singh.
The ground averred in the petition that cross-cases have
been registered inter se between the parties in relation to the
same incident cannot be considered to be a reason to quash the

impugned FIR by exercising inherent powers of this Court.
According the misc. petition is dismissed as being devoid of merit.
The stay application is also dismissed.
Copy of this order shall be communicated by the learned
Public Prosecutor to the IO forthwith.
