1. Despite service no one appears on behalf of the respondent.

2. Learned counsel for the review petitioners submits that

identical orders were passed in the case of some other petitioners

and when an appeal was filed against such judgments, the

Division Bench vide its judgment dated 26.05.2009 (Annex.2) was

pleased to reverse the same.

3. Considering the submissions so made, the review petition is

allowed. The order dated 16.11.2006 is, hereby, recalled.

4. The writ petition is restored to its original number.
