Judgment

30/04/2021

The petitioner convict was granted regular parole of seven

days under Rule 18 of Rajasthan Prisoners Release on Parole

Rules, 1958 vide order dated 03.07.2020 passed in D.B. Criminal

Writ Petition No.171/2020. The convict was required to furnish

personal bond in the sum of Rs.80,000/- with two sureties of

Rs.40,000/- each as a pre-requisite condition for him to be

released on parole. The convict has forwarded the instant

application from jail mentioning that looking to his poor condition,

he should be released on parole on furnishing a personal bond

only. The family status report of the convict has been filed by the

respondents which indicates that two of the petitioner's brothers

own houses constructed under the Prime Ministers Housing

(2 of 2) [CRLW-136/2021]

Scheme. The petitioner's children are minor and since the

petitioner has been convicted for the murder of his wife, the

children are living at their maternal grandfather's house.

In the peculiar facts noticed above, it is hereby directed that

the convict-petitioner Ramjan S/o Ghisu Khan shall be released on

first parole by furnishing a personal bond in the sum of

Rs.80,000/- and one surety of Rs.40,000/- to the satisfaction of

the Superintendent, Central Jail, Jodhpur.

With the above modifications in the order dated 03.07.2020,

the instant parole writ petition is disposed of.
