The present bail application has been filed under Section 439

Cr.P.C. on behalf of the petitioner, who is in custody in connection

with FIR No.09/2009, Police Station Panarwa, District Udaipur, for

the offences under Sections 420 and 406 IPC.

Heard learned counsel for the petitioner and learned Public

Prosecutor and perused the material available on record.

The petitioner is in judicial custody for the above offences,

which are triable by the Court of Magistrate. The FIR was

registered way back in the year 2009.

Having regard to the facts and circumstances of the case and

upon a consideration of the arguments advanced at the bar, this

Court is of the opinion that the bail application filed by the

petitioner deserves to be accepted.

Consequently, the bail application is allowed. It is ordered

that the accused-petitioner Sukhdev arrested in connection with

FIR No.09/2009, Police Station Panarwa, District Udaipur shall be

released on bail; provided he furnishes a personal bond of

Rs.80,000/- and two surety bonds of Rs.40,000/- each (of which

one shall be a local surety) to the satisfaction of the learned trial

court with the stipulation to appear before that Court on all dates

of hearing and as and when called upon to do so.
