Matter comes up on an application for modification of

the order dated 5.7.2018 passed by this Court.

Learned counsel for the appellant submits that vide

order dated 5.7.2018 passed by this Court, this Court while

issuing notices to the respondents, stayed execution of the

impugned judgment and decree, but now the respondents are

raising construction so as to change the nature of the property

and frustrate the partition.

Having heard the learned counsel for the parties and

taking into consideration the facts and circumstances of the case,

it is directed that the status-quo, as exists today, shall be

maintained by the parties.

Interim order dated 5.7.2018 is modified as indicated

above.

Application stands disposed of accordingly.
