1. Prayer made in this petition is for releasing the benefit of ACP scale by placing reliance in the judgment in case of State of Haryana and others vs. Ram Sarup Ganda and others, Civil Appeal No. 3250 of 2006, decided on 02.08.2006.

2. Learned State counsel draws the attention of this Court to the preliminary objections/submissions of the written statement stating therein that the issue involved in the aforesaid case was receipt of less pay by the seniors while higher was being drawn by the junior employees in the same cadre. However, in the present case petition, there is no reference to any junior drawing higher pay scale than the petitioner.

3. Disposed of, reserving the petitioner with a liberty to get it revived, in case need arises.
