1. This order shall dispose of the above mentioned petitions as the similar
questions of law and facts are involved therein for adjudication. For the sake of
convenience, facts are being culled out from CWP No.7615-2023 titled as 'Ashok
Gupta and ors. vs. Union of India and ors.'
2. The instant petition has been filed by the petitioners under Articles
226/227 of the Constitution of India, seeking a writ in the nature of certiorari,
quashing the letter dated 06.02.2023 (Annexure P-2), issued to petitioner No.1 as
well as the similar notices issued to other petitioners, vide which the pension of
the petitioners is sought to be reduced without any basis and without considering
the mandate of law. Further a writ of mandamus has been sought for directing the

respondents to pay back the amount unlawfully deducted from the pension of the
petitioners from the month of January, 2023 onwards immediately and the
pension of the petitioners be kept intact.
3. Mr. Sunish Bindlish, Advocate has put in appearance on behalf of
respondent No.4-Punjab Agro Industries Corporation Ltd. and filed reply in the
Court today which is taken on record.
4. Learned counsel for the respondent- Employees Provident Fund
Commissioner submits that he wishes to adopt the reply filed by respondent No.4
in CWP-7615-2023.
5. Allowed to do so.
6. Learned counsel for the parties are ad idem that the present case is
squarely covered by the judgment rendered by a Co-ordinate Bench of this Court
in CWP-5378-2024 titled as Inderjit Singh Kaknian and others Versus Union of
India and others and other connected cases, decided on 12.09.2024.
7. Disposed of in the same terms as CWP-5378-2024 titled as Inderjit
Singh Kaknian and others Versus Union of India and others and other
connected cases, decided on 12.09.2024.
