Petitioner is impugned the judgment dated 29.10.2015

passed by the Court of learned JMIC, Patiala, whereby he has been

convicted for the offence under Section 138 of the Negotiable

Instruments Act, appeal against which preferred by the petitioner has

been dismissed by learned Additional Sessions Judge, Patiala.

2. Learned counsel for the petitioner submits that it is a

matter of record that the matter stands amicably settled between the

parties before the Mediation and Conciliation Centre of this Court.

Learned counsel submits that in the circumstances, the instant petition

may be disposed of by setting aside the impugned judgments.

3. Learned counsel for respondent No.1/complainant does not

dispute the submissions made by the counsel opposite and also does not

oppose the prayer made by the counsel for the petitioner for setting

aside the impugned judgments in view of the settlement so affected

between the parties.

4. I have heard learned counsel for the parties and perused the

relevant material on record.

5. In the facts and circumstances as enumerated hereinabove,

the instant revision petition is allowed. Impugned judgment of

conviction and order of sentence dated 29.10.2015 passed by learned

JMIC, Patiala, as well as judgment dated 03.11.2016 passed by learned

Additional Sessions Judge, Patiala, are hereby set aside.
