Challenge in the present is to the order dated 03.11.2017

passed by respondent No.3-Ombudsman Electricity, Punjab and also to

the order dated 03.07.2017 passed by Consumer Grievances Redressal

Forum directing the petitioner to deposit the demand as raised by the

respondent-distribution licensee due to revision of the bill on account

of noticing the error of applying wrong multiplication factor.

The contention of the petitioner is to the fact that by virtue

of Section 56 of the Electricity Act, 2003, the demand could not have

been raised for the entire duration when the wrong multiplication factor

was applied and that the same could be charged only with effect from

the period of 06 months prior to the detection of the error in application

of a wrong multiplication factor and that there was no fault on the part

of the petitioner in the bills being raised by the respondent-distribution

licensee by application of a wrong multiplication factor. The issue has

already been dealt by this Court in CWP-5877-2019 titled as "Uttar

Haryana Bijli Vitran Nigam Ltd. and others versus M/s Shree Durga

Spinning Mill and another"

The present writ petition is accordingly dismissed in view

of the judgment rendered by this Court in CWP-5877-2019 titled as

"Uttar Haryana Bijli Vitran Nigam Ltd. and others versus M/s Shree

Durga Spinning Mill and another" (Supra).
