The instant application has been filed for withdrawal of the

main appeal i.e. RSA-608-1993.

Learned counsel for the applicant-appellant wishes to withdraw

the present appeal as the matter has already been amicably resolved between

the parties and he has specific instructions to withdraw the same. The

photocopy of the compromise is also appended with the present application.

The application is duly supported with affidavits of the sons and daughter of

deceased appellant.

Learned counsel appearing on behalf of the respective

respondents do not dispute the prayer made in the application.

In view of the averments made in the application, the same is

allowed.

Main case:

The instant appeal had been instituted by the appellant (since

deceased) against the judgment and decree dated 15.03.1991 passed by the

Additional District Judge, Hisar, in Civil Appeal No.57-CA of 1987,

whereby the judgment passed by the trial Court was reversed.

In view of averments made in CM-2803-C-2024 and

submission of learned counsel for the respondents, the present appeal is

dismissed as withdrawn.

The civil misc. application, if any, stands disposed of.
