1. Petitioner has filed the present petition under Section 482 of the

Code of Criminal Procedure, for quashing the impugned order dated

08.01.2001 (Annexure P-2) in case FIR No.110, dated 06.11.1998, under

Sections 120-B, 406, 419, 420, 467, 468, 471 of the Indian Penal Code,

registered at Police Station Sadar Phagwara, District Kapurthala, whereby

the petitioner was declared as proclaimed offender.

2. Learned counsel for the petitioner submits that the petitioner is

ready and willing to surrender before the trial Court and hence he may be

permitted to withdraw the present petition. He further submits that an

appropriate direction be issued to the trial Court that if the petitioner moves

an application for regular bail, the same be decided in a time bound manner.

3. In view of the above, the present petition is dismissed as

withdrawn. In case, the petitioner surrenders before the trial Court within a

period of two weeks from today and also moves an application for grant of

regular bail, the same shall be considered/decided by the learned trial Court

expeditiously, preferably within a period of two months from the date of

moving such application, in accordance with law.

4. The petition is accordingly disposed of.
