SURESHWAR THAKUR, J. (ORAL)

1. Learned Addl. Advocate General, Haryana does not oppose the

making of a mandamus upon the authorities concerned, seized with Annexure

P-2, to decide the same in a time bound manner.

2. Accordingly, a mandamus is made upon the competent authorities

concerned, seized with Annexure P-2, to make a speaking decision thereon, but

most expeditiously and after hearing all affected persons concerned.

3. Furthermore, since it is stated at the bar by the learned counsel for

the petitioners that even in the statutory appeal, an application has been filed,

seeking the staying of the operation of the verdict challenged before the

Appellate Court, but he further submits that, no order has been passed

thereons. Consequently, on the said application, a valid decision be made

within two weeks from today, but after hearing all affected persons concerned.

4. Till a decision is made on the said application, thereupto, the

parties are directed to maintain status quo, as of today, in respect of the

disputed lands.

5. There is a noticeable spate of litigations which arise from sheer

indolence on the part of the Appellate Authorites concerned, in theirs making

prompt decisions upon the relevant applications filed within the statutory

appeals, thus, seeking stay of the operation of the apposite impugned verdicts.

Therefore, the Additional Chief Secretary (Revenue) to Govt. of Haryana, is

directed to ensure that the said spate of litigations becomes ebbed, through

directions being made to the competent Appellate Authorities concerned,

seized with the apposite applications, which are filed by the aggrieved,

whereby, they seek stay of the operation of the judgments which are

challenged therebefore, thus, to make most expeditious decisions thereons.

6. In consequence, therebys all the competent Appellate Authorites

concerned, who are seized with such applications, thus, are directed to, but

within a period of two weeks from theirs become so instituted, hence pass

lawful speaking decision thereons.

7. All pending application(s), if any, is disposed of accordingly.
