By way of present appeal, challenge has been laid to the

judgment and decree dated 24.10.1998 passed by the Court of District Judge,

Jalandhar (hereinafter to be referred as "First Appellate Court"),

whereby the appeal filed against the judgment and decree dated 07.09.1996

passed by the Court of Civil Judge (Junior Division), Jalandhar (hereinafter

to be referred as "trial Court"), dismissing the suit for damages (filed at

the instance of respondents-plaintiffs), was allowed thereby decreeing the

suit.

[2] Notice of the appeal stood issued vide order dated 18.09.1999

passed by this Court.

[3] A perusal of the record shows that the operation of impugned

judgment and decree dated 24.10.1998 passed by the First Appellate Court,

has never been stayed.

[4] Learned counsel for the appellants submits that despite having

been made all sincere efforts, the appellants are not responding.

[5] In view of the above, it appears that the appellants are not

interesting in pursing the present appeal any further and as such, there is no

option except to the dismiss the appeal for want of prosecution.

[6]            Ordered accordingly.

[7]            However, the appellants would be at liberty to seek revival of

the present appeal, in case any cause survives.

[8] Registry to convey the copy of this order to the appellants as

well as respondents on their address.

[9] Pending miscellaneous application(s), if any, shall also stand

disposed off.
