Present regular second appeal has been filed challenging the

judgment and decree of the lower Appellate Court dated 20.05.1996 by

which, order of suspension dated 13.09.1991 has been set aside.

It may be noticed that present appeal is pending consideration

for the last 28 years and as there is no interim order passed by this Court and

respondent-plaintiff must have retired since long coupled with the fact that

by the time, suspension order dated 13.09.1991 was set aside, respondent-

plaintiff has even otherwise been reinstated in service in the year 1992

hence, the present appeal, due to efflux of time has been rendered

infructuous and the same is accordingly disposed of.
