1. By way of present petition filed under Section 11(6) of the Arbitration

and Conciliation Act, 1996 (for short 'the Act'), petitioner has approached this Court

for appointment of a sole Arbitrator to adjudicate the dispute between the parties.

2. Written statement has been filed on behalf of the respondents, which is

taken on record. Copy has been suplied to the counsel for the petitioner.

3. Counsel for the parties have been heard.

4. When confronted with the judgment dated 23.01.2024 passed by this

Court in ARB-160-2023 titled as Rajinder Kumar Contractor Versus State of

Haryana and others, whereby in similar circumstances, bunch of petitions were

dismissed by this Court holding that the claim is ex facie time barred, counsel for the

petitioner has sought and is granted permission to withdraw the petition with liberty

to approach this Court again with better particulars.

5. Dismissed as withdrawn with liberty as aforesaid.
