1. Challenge in the present appeal is to the judgment and decree

dated 29.08.1992 passed by the Additional District Judge, Gurgaon, whereby

the judgment and decree dated 01.09.1990 passed by the Sub-Judge,

Gurgaon, has been reversed.

2. Pursuant to the order dated 16.12.2023, it has been informed

that the respondent-Firm is closed.

3. Learned counsel for the appellants contends that he has no

instructions as regards the status of the respondent-M/s Imperial Malts

Private Limited.

4. Considering that it was a suit for permanent injunction against

the recovery of a sum of Rs.76,278.66 as on 06.03.1987 and the same was

decreed restraining the appellant-Distribution Licensee from effecting the

recovery and also the fact that the respondent-plaintiff/Firm has already been

closed down, the claims, if any could have been recovered only by way of

lodging an appropriate proceeding before the competent authority. As no

status of the respondent-plaintiff is forthcoming from the appellant-

Distribution Licensee, it seems that they have no further contesting interest

in the matter.

5. The present appeal is accordingly dismissed for non-

prosecution.
