Learned counsel for the State, on instructions from Naveen

Kumar Sharma, Assistant from the office of Chief Secretary, Haryana,

submits that the judgment and decree dated 25.08.1999, passed by the

learned Lower Appellate Court whereby the suit of the plaintiff was

decreed, by reversing the findings recorded by learned trial Court has

already been implemented in execution. He further submits that the

respondent has unfortunately died on 15.05.2008 and his wife is getting

the family pension.

In view of the above, no further cause survives in the

present appeal and the same is disposed of accordingly.
